Collective land ownership rights and the indigenous movement in Latin America
Propiedad colectiva de la tierra y movimiento indígena en América Latina
Abstract
Based on contemporary developments concerning the protection of private property rights in the field ofinternational law, this article traces the development of the content and scope of indigenous collective land ownership rights protected by the innovative jurisprudence of the Inter-American Human Rights System (IAHRS) on the matter. From this perspective, it discusses how rulings on the matter are shaping will shape indigenous movements in Latin America and their strategies to define and advance their political objectives in the future.
A la luz de los desarrollos de la protección del derecho a la propiedad privada en elámbito del derecho internacional, este artículo analiza el contenido y alcances del derecho jurisprudencial a la propiedad colectiva de tierras indígenas creado mediante las innovadoras providencias del Sistema Interamericano de Derechos Humanos (SIDH). Desde ese otero, se discute cómo estos avances jurisprudenciales incidirán sobre los movimientos indígenas en América Latina y sus estrategias para definir y avanzar sus objetivos políticos.
